Termination
of Appointments
Term appointments and tenure can be
terminated by the Institution for cause as determined
by the Institution, such as serious personal misconduct,
serious disregard of duties or serious Institution
financial exigency. Term appointments or tenure may
also be terminated due to retirement, resignation,
or expiration of term. In cases of termination for
cause only and with the exception of termination for
financial exigency, the following process shall be
followed:
The Senior Associate Director and Director
for Research prepares a document for discussion by the
Appointments and Promotions Council. The Director, upon
the advice and recommendation of the Appointments and
Promotions Council, recommends to the Executive Committee
of the Board of Trustees that an individual's appointment
be terminated. The individual concerned is notified
in writing of the reasons for termination, and is given
a period of 2 weeks to request an appeal. If an appeal
is requested, the individual is given 1 month to prepare.
The individual shall have the right to have personal
counsel present for advice, to confront witnesses and
to call witnesses on his or her own behalf. A hearing
will be conducted by the Executive Committee or at least
3 members of the Executive Committee who shall have
authority to act for the Executive Committee. A record
of the hearing shall be kept by the Clerk of the Corporation
and a copy of it, together with a written statement
of the decision of the Executive Committee, shall be
provided to the individual concerned. The determination
of the Executive Committee and the conduct of the hearing
(within these guidelines) shall be subject to the exclusive
discretion of the Executive Committee. The action of
a majority of the Executive Committee shall be final.
It is the policy of the Institution to
support its Scientific Staff when necessary through
the use of income from endowment, plus other available
resources. The Institution will continue to make the
effort to provide salary continuance support the top
priority when making decisions about the use of funds.
In the case of financial exigency, the Institution's
Administration, in conjunction with the Board of Trustees,
will determine how the available resources will be used
to maintain the health and effectiveness of the Institution.
After consideration of all reasonable
alternatives, in the Institution's judgement, to avoid
having to terminate a tenured appointment because of
financial exigency, the Institution will give as much
advance notice as is reasonable under the circumstances.
